Site Policy

This Site Policy (hereafter referred to as "the Policy") stipulates the conditions of use of the service named “openddl.com” provided by Nikken Sekkei Ltd. When using this Service, the User as stipulated in Article 2 (10) of the Policy shall be deemed as having consented to the Policy from the point of time when his or her use of the Service started.

Article 1 [Applicability]

The Policy is made for the purpose of prescribing the conditions, under which the Service is provided and conditions of use of the Service, and shall be applied to all the relations in connection with the use of the Service between the User and the Company.

Article 2 [Definitions]

The terms used in the Policy shall have the meanings as stipulated below.

(1) "the Company": Nikken Sekkei Ltd.
(2) "the Website": Website with the domain name "openddl.com" operated by the Company
(3) "the Service": service named "openddl.com" provided by the Company
(4) "Intellectual property right": copyrights, patent rights, utility model rights, design rights, rights of trademark and all the other intellectual property rights
(5) "Visitor": an individual or a corporation excluding the Contributor, who accesses the Service
(6) "Registrant": an individual or a corporation registered for the Service in accordance with Article 6 [Registration]
(7) "Registered Matters": information entered by the Registrant through the Service
(8) "Contributor": an individual or a corporation contributing contents (including but not limited to programs, texts, pictures, animated films, and other data) to the Service in accordance with Article 7 [Contribution]
(9) "Contributed data": contents contributed by the Registrant using the Service
(10) "User": any individual or corporation, who/that is a Visitor, a Registrant, or a Contributor
(11) “Social netwaorking Service”: Facebook Service or Google Service (hereafter referred to as “SNS”)
(12) “Social network Account ID”: conbinations of SNS account ID and password that he/she using when login to the Website in accordance with Article 6 [Registration], (hereafter referred to as “SNS account ID”)
(13) “openDDL Account ID”: account ID of the Website that consists of SNS account ID and User name

Article 3 [Attribution of rights]

  1. 1. Intellectual property right concerning the Website and the Service shall be attributed to the Company in principle. However, copyrights for works of any third party, which the Company publishes under his or her grant, shall be attributed to that third party.
  2. 2. The Contributor shall represent and warrant to the Company and other Users that the Contributed Data contributed by him or her does not infringe on the rights of any third party.
  3. 3. The Contributor grants the Company the rights for copying, public distribution, oral distribution, loan, transfer, exhibition, translation, adaptation, and all the other rights regarding the Contributed Data for free and non-exclusively. Moreover, the Company shall have the right to freely sublicense similar rights to any third party specified by the Company.
  4. 4. The Contributor consents not to exercise his or her moral right about the Contributed Data contributed by him or her, against the Company or any third party who succeeded to the rights from the Company or who was granted the right by the Company.

Article 4 [Use restrictions]

When using the Contributed Data, the User shall follow the following items based on the type of use restrictions and indicated for each Contributed Data. (Click on the license name to display the explanation of the respective terms.)

(1) CCLicense: The Contributed Data can be used in accordance with the Creative Commons License. There are six types of the license.
(2) GNU GPL: The Contributed Data can be used in accordance with the GNU General Public License
(3) MIT License: The Contributed Data can be used in accordance with the MIT License
(4) Apache License: The Contributed Data can be used in accordance with the Apache License, Version 2.0
(5) All rights reserved: Copyright to the Work belongs to a third party, and when using it one needs to obtain consent directly from the copyright owner.

Article 5 [Prohibited matters]

When using the Service, the User shall not engage in any actions corresponding to the following:

(1) Actions violating laws and regulations or actions related to criminal acts
(2) Deceitful or threatening actions towards the Company, other Users of the Service, or other third parties
(3) Actions violating public order and morals
(4) Actions infringing on the intellectual property rights, portrait rights, rights of privacy, honor, or any other rights or profits of the Company, other Users of the Service, or other third parties
(5) Actions of transmitting through the Service to the Company, the Website, or other Users of the Service information corresponding to the following or deemed by the Company as corresponding to the following:

- Information that contains violent, cruel, or obscene expressions
- Information that contains expressions promoting discrimination
- Information that contains expressions displeasing to others
- Information that contains expressions promoting suicide or self-harming behavior
- Information that contains expressions promoting inappropriate use of drugs
- Information that contains antisocial expressions
- Information requesting spreading of information to third parties through forwarding of chain-type emails and other methods
- Information posted for the purpose of associating with unacquainted members of the opposite sex.
- Information that contains computer viruses or other harmful programs
- Information that contains expressions that harm the honor or trust of the Company, other Users of the Service, or other third parties
- Information that contains deceitful or threatening expressions

(6) Actions that impose excessive loads on the network or system of the Service
(7) Actions that may interfere with management of the Service
(8) Actions that contain unauthorized access to the network or the system related to the Service or actions of trying to make such unauthorized access
(9) Actions of impersonating any other third party
(10) Actions of using the Service for advertising, announcements, soliciting, or profit making without the Company's prior consent
(11) Actions of gathering information of other Users of the Service
(12) Actions that are disadvantageous, damaging, or displeasing to the Company, other Users of the Service, or any other third parties
(13) Actions of registering/contributing false information
(14) Action of publishing contents which may lead to identification of third party individuals
(15) Actions inconsistent with rules concerning use of the Service published on the Website
(16) Actions directly or indirectly inducing any of the actions listed in this Article 5 or making it easy to conduct the same
(17) Other actions that are deemed by the Company as having a possibility to correspond to any of the actions listed in this Article 5 and other actions determined by the Company as inappropriate

Article 6 [Registration]

  1. 1. An individual or a corporation (hereinafter referred to as the "Intending Registrant"), who wishes to contribute to the Website, upon consenting to observe the Policy, can apply to the Company for registration to make contributions to the Service, and can get “openDDL account ID”. For using of SNS account ID and submitting the following information to the Company by method stipulated by the Company:

(1) User name (nickname when posting)

  1. 2. The Intending Registrant, who submitted his or her application for registration according to stipulations of the Clause 1, Article 6 (hereinafter referred to as the "Applicant for Registration"), shall be registered by the Company for the Service. However, registration may be refused if the Applicant for Registration corresponds to any of the following. In such cases, the Company shall have no obligation to disclose the reasons.

(1) If the Applicant for Registration has been temporarily prohibited from applying to the Company for registration to the Service or his or her registration has been canceled
(2) If the Company has imposed restrictions of new registrations
(3) In other cases if the Company decides that the Company cannot accept the Applicant for Registration

  1. 3. When you register for this service using your SNS account ID, the following information will be obtained from your SNS account for the purpose of simplifying user registration and using it as account information on this site. The acquired information will be saved in your openDDL account as initial registration information. The saved openDDL account information can be changed or deleted from the account page .

(1) User name (nickname when posting)
(2) User Icon Image

Article 7 [Contribution]

  1. 1. The Registrant can contribute contents to the Website by methods prescribed in the Website.
  2. 2. When contributing contents, the Registrant shall choose one of the use restrictions for the Work from No. 1 to No. 5 of Article 4. (=> Click here for Contribution procedure.)

Article 8 [Changes of Registered Matters]

  1. 1. The Registrant can change his or her user name by methods prescribed on the Website.
  2. 1. If a registrant wishes to change his or her user name, he or she can change or delete it from the the account page of the Site.

Article 9 [Management of SNS account ID]

  1. 1. The Registrant shall manage the registered SNS account ID on his or her own responsibility.
  2. 2. If the Registrant forgets his or her SNS account ID or delietes his or her SNS account ID from SNS, he or she cann’t login to the Website. He or She has to registe to the Website newly.
  3. 3. Even if a Contributor forgets his or her SNS account ID or delietes his or her SNS account ID from SNS, the Contributor's Contributed Data shall still be published on the Website. Moreover, publication of such contributions may be terminated when deemed necessary by the Company.

Article 10 [Cancellation, etc. of Registration]

  1. 1. If the Contributor’s action corresponds to any of the following, the Company can delete Contributed Data without any notice. Moreover, if the Registrant’s action corresponds to any of the following, the Company can temporarily suspend use of the Service by the Registrant or cancel his or her registration as a Registrant without any notice. (hereinafter, these actions shall be collectively referred to as "Cancellation, etc. of Registration").

(1) If the Registrant infringes on any articles or clauses of the Policy
(2) If it becomes clear that the Registered Matters contain falsehood
(3) If the Registrant conducts an action that corresponds to items of Article 5 [Prohibited matters]
(4) If the Registrant corresponds to items No. 1 or No. 3 of Clause 2, Article 6 [Registration]
(5) In other cases if the Company decides that use of the Service or registration as a Registrant is not suitable

  1. 2. The Registrant shall compensate for damages incurred by the Company as a result of actions corresponding to the items of Clause 1, Article 10.
  2. 3. The Company shall not in any way be liable for any damages incurred by the Registrant as a result of Cancellation, etc. of Registration conducted by the Company on the basis of Clause 1, Article 10.

Article 11 [Withdrawal from membership]

  1. 1. The Registrant can cancel his or her registration as a registrant by withdrawing from the Service through the account page of the Website.
  1. 2. After withdrawal from membership, the following information shall be deleted from the registration for this service.

(1) User name (nickname when posting)
(2) User Icon Image

  1. 3. Even if a Contributor withdraws from membership with the Service, the Contributor's Contributed Data shall still be published on the Website. However, the user name of such Contributed Data shall be deleted. Moreover, publication of such contributions may be terminated when deemed necessary by the Company.

Article 12 [Handling of Registered Matters]

  1. 1. Personal Information of Registant are managed by SNS that he or she used to registration, the provision of this SNS are applies.
  2. 2. The purpose of use of the Registered Matters in the Service shall be as follows.

(1) Management of the Registrant's Contributed Data

Article 13 [Suspension, etc. of the Service]

  1. 1. In the following cases, the Company can suspend or discontinue all or a part of the Service without notifying the User beforehand.

(1) When conducting emergent or regular inspections or maintenance work of computer systems related to the Service
(2) If a computer or a communication line is not in order due to an accident
(3) If operation of the Service becomes difficult due to force majeure, such as earthquake, falling of a thunderbolt, fire, storm and flood damages, power cut, or a natural disaster
(4) If operation of the Service becomes difficult for political reasons such as war, disturbance, rebellion, riot, labor dispute, etc.
(5) In other cases if the Company decides that suspension or discontinuance is required

  1. 2. The Company shall not in any way be liable for any damages incurred by the User or any third party as a result of measures taken by the Company according to Clause 1, Article13.

Article 14 [Changes of contents of the Service, and termination]

  1. 1. The Company may at its discretion change the content of the Service or terminate the Services. Furthermore, if the Company terminates the Service, the Company shall give a notice thereof on the Website beforehand.
  2. 2. The Company may at its discretion entrust operation of the Service to any third party, or transfer the Service to a third party.
  3. 3. The Company shall not in any way be liable for any damages incurred by the User as a result of measures taken by the Company according to this Article 14.

Article 15 [Exemption from responsibility and liability]

  1. 1. The Company makes no warranty on the Service regarding its fitness or suitability for a particular purpose contemplated by the Registrant, or on that the Service has expected functions, commercial value, accuracy, or usefulness, or on that the use by the Registered User of the Service complies with the laws and regulations applicable to the Registrant, or on that the Service will be free of defects).
  2. 2. The Company shall not be liable for any damages incurred by the Registrant arising out of discontinuance, suspension, termination, unavailability, or modification by the Company of the Service, cancellation or loss of the Contributed Data, deletion of the registration of the Registrant, loss of Contributed Data or failure of or damage to equipment through the use of the Service, or otherwise in connection with the Service.
  3. 3. The Company shall not in any way be liable for transactions, communications or disputes arising between the Registrant and other Registrants or a third party in connection with the Service or the Website.

Article 16 [Changes of the Policy, etc.]

  1. 1. The Company may at its discretion change the Policy, and the amended Policy shall enter into force as of the time the Company gives a notice thereof on the Website.
  2. 2. The User shall be deemed as giving consent to the amended Policy as of the time when he or she starts use of the Service after the change of the Policy enters into force, and the amended Policy shall be deemed as valid between the Company and the User.
  3. 3. The User shall not express his or her approval or disapproval of the contents of Clause 2, Article 16.

Article 17 [Communication and notices]

  1. 1. The Company shall not communicate with or notify the User individually.
  2. 2. The Company shall not respond to individual inquiries from the User.

Article 18 [Governing law and court of jurisdiction]

  1. 1. The Policy shall be governed by the laws of Japan.
  2. 2. Any and all disputes arising out of or in connection with the Policy shall be submitted to the exclusive jurisdiction of the Tokyo District Court in the first instance.
